Terms of Service

These Terms of Service govern your access to and use of Rested, including the Rested website, dashboard, agent, APIs, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms.

1. The Service

Rested provides a hosted control plane for configuring, running, monitoring, and recovering encrypted backups from supported Linux servers and databases. The Service may include a dashboard, a locally installed Rested agent, APIs, notifications, and integrations.

Rested is not your storage provider. In the standard setup, the agent encrypts backup data locally with restic and sends it to storage that you choose and control. Rested stores the orchestration data needed to operate the Service, including account, configuration, status, and encrypted values.

2. Accounts and access

You must provide accurate account information and keep your authentication methods secure. You are responsible for activity carried out through your account and for ensuring that anyone you authorize to use it follows these Terms.

You may use the Service only if you can lawfully enter into a contract. If you use the Service for an organization, you confirm that you have authority to bind that organization to these Terms.

3. Your responsibilities

You are responsible for:

  • installing and maintaining the Rested agent on systems you are authorized to manage;
  • providing the permissions, network access, storage account, and credentials needed for your chosen backup configuration;
  • protecting your recovery key and maintaining an independent, tested recovery plan;
  • checking backup and restore results and keeping your source, agent, storage, and database systems available; and
  • ensuring that your use of the Service and the data you process through it comply with applicable law and third-party rights.

Do not upload or process data through the Service unless you have the necessary rights and permissions. Do not use the Service to access systems, repositories, or data without authorization.

4. Backups, storage, and recovery

A successful backup command does not by itself prove that a full recovery will succeed. Backup availability depends on your agent, source systems, network, storage provider, retention settings, database tools, and recovery key. You must test restores before relying on them for business continuity.

You are responsible for storage-provider fees, storage limits, provider terms, retention and deletion settings, and the availability of any third-party service you connect to Rested. Rested does not guarantee that a third-party storage provider will preserve, accept, or return your backup data.

5. Plans, billing, and cancellation

Rested offers free and paid plans as described on the pricing page. Plan limits, included features, and prices may differ by plan and are shown before you subscribe.

Paid plans renew for the period shown at checkout until canceled. You authorize our payment provider to charge the payment method you provide for recurring charges, applicable taxes, and any amount you separately approve. You may cancel renewal through the billing controls provided in your account. Cancellation normally takes effect at the end of the current paid period unless the checkout or applicable law says otherwise.

We may change plan pricing or limits for a future renewal period. We will not reduce a paid period you have already purchased. Any mandatory refund or cancellation rights remain unaffected.

6. Acceptable use

You may not misuse the Service, interfere with its operation, bypass plan limits or security controls, reverse engineer it except where applicable law permits, probe or attack systems, or use it to distribute malware, spam, or unlawful content. You may not use the Service to infringe intellectual-property, privacy, or other rights.

We may investigate suspected misuse and take proportionate action to protect the Service, its users, and third parties.

7. Your content and our rights

You retain your rights in data and content that you submit to or process through the Service. You grant Rested a limited, non-exclusive license to host, copy, transmit, and process that content only as needed to provide, secure, support, and improve the Service, or as required by law.

Rested and its licensors own the Service, including its software, documentation, design, and trademarks. These Terms give you a limited right to use the Service while your account is active and you comply with these Terms. No other rights are transferred.

8. Privacy and security

Our Privacy Policy explains how we process personal data. You are responsible for providing any notices and obtaining any permissions required for personal data that you back up or otherwise process through the Service.

We use reasonable technical and organizational measures to protect the Service. No online service, agent, network, or storage system is completely secure, and you remain responsible for securing your accounts, machines, credentials, storage, and recovery keys.

9. Availability, changes, and third-party services

We may change, suspend, or discontinue parts of the Service, including features and integrations. We may perform maintenance and may release updates that require you to update the Rested agent. We will take reasonable steps to communicate material changes where appropriate.

The Service may link to or work with third-party services. Those services are governed by their own terms and privacy policies. Rested is not responsible for third-party services, including their availability, security, pricing, or handling of your data.

10. Suspension and termination

You may stop using the Service and close your account through the available account controls. We may suspend or terminate access if you materially breach these Terms, fail to pay amounts due, create a security or legal risk, or if we discontinue the Service.

Where reasonable, we will give notice and an opportunity to fix a breach before suspension or termination. We may act immediately when necessary to address security, fraud, unlawful activity, or risk of harm.

You should export or otherwise secure anything you need before closing your account. After termination, we may delete account information and service data in accordance with our retention practices and legal obligations. These Terms that are intended to survive termination will continue to apply.

11. Disclaimers and liability

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. We do not promise that the Service will be uninterrupted, error-free, or suitable for every backup, compliance, or recovery requirement. Nothing in these Terms limits a right or liability that cannot lawfully be limited or excluded.

To the maximum extent permitted by applicable law, Rested will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, business, goodwill, or data arising from your use of the Service. To the maximum extent permitted by applicable law, Rested’s total liability for claims relating to the Service will not exceed the amount you paid to Rested for the Service during the twelve months before the event giving rise to the claim.

12. Changes to these Terms

We may update these Terms when the Service, the law, or our business changes. We will post the updated Terms and change the “Last updated” date. If a change materially affects your rights or obligations, we will provide additional notice where required. Your continued use of the Service after the effective date means that you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws that apply in the jurisdiction where the operator of Rested is established, without regard to conflict-of-law rules. Subject to mandatory law, the courts of that jurisdiction have jurisdiction over disputes relating to the Service.

If you are a consumer, nothing in this section removes mandatory consumer protections or your right to bring a claim in a court available under applicable law.

14. General terms

If a provision of these Terms is held unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent, except as part of a merger or sale of substantially all of your business. We may assign these Terms as part of a reorganization, merger, acquisition, or sale of assets.

These Terms and any order or plan details shown at checkout form the agreement between you and Rested about the Service. They replace earlier agreements about the same subject, except for a separate written agreement that expressly overrides them.
